1) Scope of Application
1.1 These General Terms and Conditions (hereinafter “GTC”) govern the contractual relationship between Adriaan van Veen – Mobile Proxy Germany, Am Brabrinke 14, 30519 Hannover, Germany (hereinafter “Provider”), and its contractual partners in the form of end customers (hereinafter “Users”).
1.2 Deviating General Terms and Conditions of the User shall not apply, even if the Provider has not expressly objected to them.
1.3 The Provider reserves the right to change these GTC at any time for good cause, especially due to changes in the law, Supreme Court rulings, or market conditions. The User will be informed about planned changes by email. The changed GTC will be attached, highlighting the changes. The User may object to the changes within 14 days of receipt of the email. If no objection is made, the changes shall be deemed tacitly accepted. This legal consequence will be expressly pointed out in the notification. If the User objects, the Provider may terminate the contract early for good cause. Additionally, the User may terminate the contract within 3 months after receiving the change notification without stating reasons and without notice period. Such termination will take effect no earlier than when the changes come into force. If no timely termination occurs, the changes are considered accepted.
1.4 Deviating agreements between Provider and User shall take precedence over these GTC if made in writing.
2) Subject of the Contract
2.1 The Provider offers mobile services in the form of proxy services for payment. After conclusion of the contract and payment of the usage fee, the User is granted access to the Provider’s proxy service (hereinafter “Service”). This enables the User to connect to the Internet via a mobile proxy server.
2.2 The functional scope of the Service results from the current service description available at https://germanproxy.io.
2.3 The exact scope of services (data transmission speed, data standard, data volume, IP rotation, number of permitted users) depends on the product selected by the User and the information on the website.
2.4 The Service is an IT routing service and does not constitute a telecommunications service within the meaning of the Telecommunications Act.
3) Conclusion of Contract
3.1 The contract is concluded upon confirmation by the Provider via email (“Order Confirmation”) or activation of the Service.
3.2 The presentation of the Services on the website constitutes a non-binding invitation to submit an offer. By clicking the “order with costs” button, the User makes a binding offer.
3.3 The acceptance of the offer is declared by sending the order confirmation email. An automatic order receipt email does not yet constitute acceptance.
4) User Account and Registration
4.1 The User may create an account on the website voluntarily to simplify future orders. Ordering without registration (“guest order”) is also possible.
4.2 Registration is free of charge, but there is no entitlement to register. The Provider may make registration subject to additional requirements.
4.3 Personal data stored during registration are saved so that the User can log in again at any time.
5) Ordering Process
5.1 Users can add products to the shopping cart and adjust quantities or remove items.
5.2 User data are collected during the ordering process and can be corrected. The ordering process can be canceled at any time by leaving the site.
5.3 On the summary page, the User receives an overview of the order before submitting.
6) Service Level and Maintenance
6.1 The Provider aims for an average monthly service availability of 95%.
6.2 Planned maintenance, force majeure, third-party attacks, and network provider outages are not counted as downtime.
6.3 If the guaranteed availability is not met and the User is affected, a partial refund may be requested. No refund will be given if the limitations are caused by external circumstances as described in Section 9.1. The refund amount depends on the average monthly availability:
- 90–94.99% → 25% refund
- 80–89.99% → 50% refund
- 50–79.99% → 75% refund
- 0–49.99% → 100% refund
6.4 Maintenance work is usually performed on Sundays.
6.5 The User must report any availability issues. A claim for restoration exists only if the guaranteed availability is below the promised level.
7) Support
7.1 Support requests can be sent by email to [email protected] or via Telegram (@germanproxy_io_bot).
7.2 There is no entitlement to a response within a specific timeframe.
8) User Obligations and Rights
8.1 The Service is intended for exclusive use by the User. The User may use the Service on multiple own devices but must ensure that only they use the access. Sharing or granting access to third parties is prohibited.
8.2 The User undertakes not to misuse the Service, in particular not to commit or support illegal acts.
8.3 The User may not use software that interferes with the Service, causes excessive load, or disrupts infrastructure.
8.4 Access data must be kept confidential and not disclosed to third parties.
8.5 Changes to the data provided during registration must be communicated promptly.
9) Refund Policy
9.1 Refunds are excluded if service use is restricted due to external circumstances beyond the Provider’s control, including faulty end devices or network setup, IP blocking by third parties, regional restrictions, geoblocking, high IP fraud scores, or country-specific network filters. Furthermore, as part of the Provider’s compliance, anti-fraud and anti-money-laundering strategy, the Provider maintains a list of restricted platforms with elevated misuse and money-laundering risk. This list includes — by way of example and not limitation — kleinanzeigen.de, ebay-kleinanzeigen.de, vinted.de and other European online classifieds and peer-to-peer resale marketplaces, retail online-banking portals of major DACH-region banks, CS:GO / CS2 skin-trading and skin-gambling platforms, carding forums and stolen-data marketplaces, as well as selected postal address-change endpoints. The current full list and categories are available at https://germanproxy.io/restricted-platforms and may be updated by the Provider at any time. No refunds will be issued due to restrictions resulting from this list. For Category 1 (Online Classifieds and P2P-Resale Marketplaces), customers may submit an unblock request by email pursuant to the process described in Section 10.4.
9.2 For payments made via cryptocurrency, refunds can only be processed to a USDC wallet address on the Ethereum network (ERC-20). Refunds to other cryptocurrencies, networks, or wallet types are not possible.
9.3 In accordance with EU regulations (Travel Rule), the User must provide the following information to process a cryptocurrency refund:
- Full legal name
- Date of birth
- City of birth
- Type of wallet used (personal hardware wallet or exchange wallet; if exchange, the name of the exchange provider must be specified)
The Provider cannot guarantee the successful transfer of funds if the information provided is incomplete or incorrect.
10) Prohibited Uses
10.1 The following uses are technically blocked and thus prohibited:
- Providing telecommunications services to third parties
- Operating as a mediation system (e.g., SIM boxing)
- Permanent connections (leased lines)
- Automated machine-to-machine communication without permission
- Use involving compensation per connection
- Sending SMS or mass communication (spam)
10.2 The Provider implements technical measures to effectively prevent the prohibited uses under 10.1. These measures include but are not limited to:
- Limiting connection duration through session-based usage with automatic time limits
- Daily automatic restart of routing hardware to prevent permanent connections
- Exclusion of voice and SMS services
- Prevention of VoIP and SIP services
- Monitoring and logging of usage to detect and prevent abusive activities
10.3 As part of the Provider’s compliance, anti-fraud and anti-money-laundering strategy (cf. Regulation (EU) 2023/1113), access to certain platforms is technically blocked. The current list of restricted platforms is published at https://germanproxy.io/restricted-platforms and is incorporated by reference into these GTC. The Provider reserves the right to add or remove platforms at its reasonable discretion based on observed misuse patterns, law enforcement requests, or regulatory guidance. Updates to this list do not constitute a change to these GTC within the meaning of Section 1.3.
10.4 Among the platform categories restricted under Section 10.3, only Category 1 (Online Classifieds and Peer-to-Peer Resale Marketplaces) is eligible for individual unblocking on customer request. All other restricted categories are subject to a hard block with no exceptions whatsoever. For Category 1 unblocking, the User must submit a written request by email to [email protected] containing (a) the customer account ID or registered email address, (b) the specific platforms requested for unblocking, (c) a detailed and specific statement of the intended legitimate purpose — generic descriptions such as “market research” or “business use” are insufficient and will result in rejection; the statement must describe concretely what activity will be performed, on which platform, for which entity, and for what commercial reason — and (d) the following acknowledgment included verbatim in the email body: “I confirm that the unblocking requested above will be used exclusively for the stated legitimate purpose. I acknowledge that any misuse — including but not limited to fraud, account takeover, stolen-goods trade, or money laundering — will result in immediate termination of the unblocking permission and my customer account without refund, and may be reported to competent authorities. I acknowledge that a materially false declaration shifts all resulting criminal and civil liability fully to me as the requesting party.” The Provider reviews each request individually at its sole discretion. The Provider may approve, reject, or request additional information and is under no obligation to provide reasons for a rejection. Requests that fail to include the required information, fail to demonstrate a plausible legitimate purpose, or appear pretextual will be rejected. There is no service-level commitment on response time. The Provider does not require submission of identity documents, business registrations, or third-party identity verification for this process; the unblocking decision is based on the plausibility of the User’s written declaration. A materially false declaration by the User constitutes a wilful misrepresentation toward the Provider and shifts criminal and civil liability for any resulting misuse fully to the User. All correspondence — including the original request, the statement of purpose, the verbatim acknowledgment, the timestamp, and the originating email address — is logged and retained for the duration of the customer relationship plus the applicable statutory retention period and may be used by the Provider in cooperation with law enforcement or in defense against third-party claims. The Provider may revoke an unblocking permission at any time without prior notice if abuse indicators are detected. Requests to unblock platforms in restricted categories 2 through 8 (retail online-banking portals, skin-trading and skin-gambling platforms, carding forums, stolen-data marketplaces, carding cash-out services, postal address-change endpoints, and dynamic threat-intelligence-blocked domains) will not be processed and may not receive a reply. The current list of restricted categories and the specific platforms covered is published at https://germanproxy.io/restricted-platforms.
11) Prices, Payment, and Duration
11.1 Prices are stated on the website in US dollars including statutory taxes.
11.2 Payment is made in advance via cryptocurrencies (e.g., USDC, BTC, ETH, LTC), credit cards (VISA, Mastercard), or PayPal.
11.3 Usage ends automatically after the booked period expires.
11.4 Extensions are only possible by placing a new order.
12) Right of Withdrawal
12.1 The User explicitly agrees that use of the digital content begins before the end of the statutory withdrawal period (§ 356(5) BGB) and thereby waives their right of withdrawal.
13) Limitation of Liability
13.1 The Provider is liable without limitation for intent and gross negligence.
13.2 For slight negligence, liability is limited to breach of essential contractual obligations and only to foreseeable, typical damages.
13.3 Liability for injury to life, body, or health remains unlimited.
13.4 Further liability is excluded.
13.5 These limitations also apply to legal representatives and agents of the Provider.
14) Data Protection and Communication
14.1 The Provider processes personal data in accordance with the GDPR. Full details on the categories of personal data processed, the legal bases, recipients (including the Provider’s processor iProxy Online Solutions LLC for connection-metadata processing), retention periods, and the data-subject rights are set out in the Provider’s Privacy Policy available at https://germanproxy.io/privacy-policy.
14.2 Communication between the Provider and the User is typically conducted by email. For communications involving personal data of the User (such as data-subject requests under Art. 15–22 GDPR or law-enforcement-related correspondence), the User and the Provider may agree on the use of encrypted channels (e.g., PGP, signed emails). The Provider’s PGP key is referenced in the Imprint.
15) Final Provisions
15.1 The contractual relationship is governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
15.2 Should individual provisions be invalid, the remaining provisions remain unaffected.
15.3 If the User is a merchant, public law entity, or special public fund, the place of jurisdiction is Hannover.
16) Voucher Code Policy
16.1 Each customer may use only one of the following voucher codes one time in total, regardless of which code it is: welcome10, warriorforum20, rentacc20, tarnkappe20, duoplus20, linkensphere20, iproxy20, tguard20.
16.2 Multiple use – including but not limited to usage via different email addresses, accounts, or other circumvention methods – is strictly prohibited.
16.3 In case of violation, the Provider reserves the right to either cancel the affected order or reduce the prepaid service period proportionally to offset the improperly obtained discount. No refund will be issued for any remaining balance.
