Terms & Conditions
1) Scope of Application
1.1 These General Terms and Conditions (hereinafter “GTC”) govern the contractual relationship between Mobile Proxy Germany, represented by Adriaan van Veen, Am Brabrinke 14, 30519 Hannover, Germany (hereinafter “Provider”), and its contractual partners in the form of end customers (hereinafter “Users”).
1.2 Deviating General Terms and Conditions of the User shall not apply, even if the Provider has not expressly objected to them.
1.3 The Provider reserves the right to change these GTC at any time for good cause, especially due to changes in the law, Supreme Court rulings, or market conditions. The User will be informed about planned changes by email. The changed GTC will be attached, highlighting the changes. The User may object to the changes within 14 days of receipt of the email. If no objection is made, the changes shall be deemed tacitly accepted. This legal consequence will be expressly pointed out in the notification. If the User objects, the Provider may terminate the contract early for good cause. Additionally, the User may terminate the contract within 3 months after receiving the change notification without stating reasons and without notice period. Such termination will take effect no earlier than when the changes come into force. If no timely termination occurs, the changes are considered accepted.
1.4 Deviating agreements between Provider and User shall take precedence over these GTC if made in writing.
2) Subject of the Contract
2.1 The Provider offers mobile services in the form of proxy services for payment. After conclusion of the contract and payment of the usage fee, the User is granted access to the Provider’s proxy service (hereinafter “Service”). This enables the User to connect to the Internet via a mobile proxy server.
2.2 The functional scope of the Service results from the current service description available at https://germanproxy.io.
2.3 The exact scope of services (data transmission speed, data standard, data volume, IP rotation, number of permitted users) depends on the product selected by the User and the information on the website.
2.4 The Service is an IT routing service and does not constitute a telecommunications service within the meaning of the Telecommunications Act.
3) Conclusion of Contract
3.1 The contract is concluded upon confirmation by the Provider via email (“Order Confirmation”) or activation of the Service.
3.2 The presentation of the Services on the website constitutes a non-binding invitation to submit an offer. By clicking the “order with costs” button, the User makes a binding offer.
3.3 The acceptance of the offer is declared by sending the order confirmation email. An automatic order receipt email does not yet constitute acceptance.
4) User Account and Registration
4.1 The User may create an account on the website voluntarily to simplify future orders. Ordering without registration (“guest order”) is also possible.
4.2 Registration is free of charge, but there is no entitlement to register. The Provider may make registration subject to additional requirements.
4.3 Personal data stored during registration are saved so that the User can log in again at any time.
5) Ordering Process
5.1 Users can add products to the shopping cart and adjust quantities or remove items.
5.2 User data are collected during the ordering process and can be corrected. The ordering process can be canceled at any time by leaving the site.
5.3 On the summary page, the User receives an overview of the order before submitting.
6) Service Level and Maintenance
6.1 The Provider aims for an average monthly service availability of 95%.
6.2 Planned maintenance, force majeure, third-party attacks, and network provider outages are not counted as downtime.
6.3 If the guaranteed availability is not met and the User is affected, a partial refund may be requested. No refund will be given if the limitations are caused by external circumstances as described in Section 9.1. The refund amount depends on the average monthly availability:
- 90–94.99% → 25% refund
- 80–89.99% → 50% refund
- 50–79.99% → 75% refund
- 0–49.99% → 100% refund
6.4 Maintenance work is usually performed on Sundays.
6.5 The User must report any availability issues. A claim for restoration exists only if the guaranteed availability is below the promised level.
7) Support
7.1 Support requests can be sent by email to [email protected] or via Telegram (@germanproxy_io_bot).
7.2 There is no entitlement to a response within a specific timeframe.
8) User Obligations and Rights
8.1 The Service is intended for exclusive use by the User. The User may use the Service on multiple own devices but must ensure that only they use the access. Sharing or granting access to third parties is prohibited.
8.2 The User undertakes not to misuse the Service, in particular not to commit or support illegal acts.
8.3 The User may not use software that interferes with the Service, causes excessive load, or disrupts infrastructure.
8.4 Access data must be kept confidential and not disclosed to third parties.
8.5 Changes to the data provided during registration must be communicated promptly.
9) Refund Policy
9.1 Refunds are excluded if service use is restricted due to external circumstances beyond the Provider’s control, including faulty end devices or network setup, IP blocking by third parties, regional restrictions, geoblocking, high IP fraud scores, or country-specific network filters.
Please note: Access to kleinanzeigen.de is intentionally blocked as part of our compliance and fraud prevention efforts. This is the only website currently restricted. No refunds will be issued due to this limitation.
10) Prohibited Uses
10.1 The following uses are technically blocked and thus prohibited:
- Providing telecommunications services to third parties
- Operating as a mediation system (e.g., SIM boxing)
- Permanent connections (leased lines)
- Automated machine-to-machine communication without permission
- Use involving compensation per connection
- Sending SMS or mass communication (spam)
10.2 The Provider implements technical measures to effectively prevent the prohibited uses under 10.1. These measures include but are not limited to:
- Limiting connection duration through session-based usage with automatic time limits
- Daily automatic restart of routing hardware to prevent permanent connections
- Exclusion of voice and SMS services
- Prevention of VoIP and SIP services
- Monitoring and logging of usage to detect and prevent abusive activities
10.3 As part of our compliance and fraud prevention strategy, access to certain websites is technically blocked. Currently, this includes kleinanzeigen.de, due to a high risk of misuse and guideline violations on that platform.
11) Prices, Payment, and Duration
11.1 Prices are stated on the website in US dollars including statutory taxes.
11.2 Payment is made in advance via cryptocurrencies (e.g., USDC, BTC, ETH, LTC), credit cards (VISA, Mastercard), or PayPal.
11.3 Usage ends automatically after the booked period expires.
11.4 Extensions are only possible by placing a new order.
12) Right of Withdrawal
12.1 The User explicitly agrees that use of the digital content begins before the end of the statutory withdrawal period (§ 356(5) BGB) and thereby waives their right of withdrawal.
13) Limitation of Liability
13.1 The Provider is liable without limitation for intent and gross negligence.
13.2 For slight negligence, liability is limited to breach of essential contractual obligations and only to foreseeable, typical damages.
13.3 Liability for injury to life, body, or health remains unlimited.
13.4 Further liability is excluded.
13.5 These limitations also apply to legal representatives and agents of the Provider.
14) Data Protection and Communication
14.1 The Provider processes personal data in accordance with the GDPR.
14.2 Communication is preferably via unencrypted channels (e.g., email), unless otherwise agreed.
15) Final Provisions
15.1 The contractual relationship is governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
15.2 Should individual provisions be invalid, the remaining provisions remain unaffected.
15.3 If the User is a merchant, public law entity, or special public fund, the place of jurisdiction is Hannover.
